I know I don't get to post here as often as I would like to but I have had a horrible thing happen and could use all of the prayers I can get. My husband and I have been providing foster care to adults with disabilities for about 10 years. We both have Master's degrees in Special Ed. Anyway, one of our clients (he was 78) either had a heart attack and fell or fell and had a heart attack back in November. It is unsure which came first. He passed away a few days later. My husband and I were charged with Patient Endangerment on Sunday. They based this charge on the false idea that we had a baby gate across the stairs and they felt he had fallen over it. The prosecutor felt this was endangering because we knew he could fall over it and left it there anyway. Here is the problem - the baby gate was never across the stairs. It has always been in the hallway next to the stairs (it leads back to our family room and kitchen area) and the EMT's are mistaken as to where they saw it. This is so ridiculous I cannot believe it. We were in the paper and on the news, for something we didn't even do. We have a lot of evidence as to where the gate actually was but the point is we are innocent and have to go through hell to prove ourselves it. We lost our foster people (we have had them for over 6 years and they were part of our family) and neither of us can work. We have absolutely no income and our defense could take up to 15,000a piece. For something we didn't do. It is so unbelieveable. We have given good care for so long and then to be treated like this. It is incredilbly difficult for me. Please pray that God help us through this difficult time and that He shows the truth in court. Thanks

The kids are fine. You know - I never thought to look at the thousand pictures we have taken to see if the baby gate is visible. Great idea! We are actually in Florida with my parents. I found out my Mom was in the hospital on Sunday morning and was out running errands when I found out we had warrants out for our arrest. We left Monday evening and got here Wednesday. I'll for sure look through the pics as soon as we get back. My mom was released from the hospital on Thursday morning. What she has wrong she just has to deal with - they said the irregular hb she is having is not a "killer", just an irritation. Let's hope they are right. Her TSH (thyroid stimulating hormone) is high and they are trying to regulate that at this time, too. I was thinking maybe the one thing is causing the other and fixing her TSH level might help with the TSH level. Thanks for all the good thoughts and prayers. We need them.

Well, yes we were arrested. Paul had to stay overnight and I was let out on bail. My best friend Shelley had the kids.

JACQUELINE - I LOVE YOU!! We found pics of the baby gate taken in July of 06. PLAIN AS DAY where it was. It is dated on the back July 06. You are so smart! Why didn't I think of that?? Shows you how messed up this has made me. I am going to call the lawyer with this information tomorrow. Thanks so much for thinking of that!

Oh, and hey... I don't know what type of gate ou are using, but wouldn't it leave marks where it was placed, and conversely none where it wasn't? I know our pressure on has left marks in doroways of the kids rooms where we used them. Just a thought.

You know Jacqueline - there is a bit of problem with that. We were in the process of remodeling when this happened. We had removed the wallpaper and had been trying to get the wallpaper paste off of the wall. We had wanted to get done before Kaitlin was born but we just didn't get finished. We were still working on it when the detective came in January. He saw everything the way it was - the holes in the wall in the hallway where we had the baby gate. He also looked at the stairs - he commented on the holes from where the previous owners had moved the handrail but it was obvious that those were from that. He said he didn't see anything on the stairs that looked like it was from a baby gate. He also commented that he was surprised that they reported that it was 5 steps up the stairs - he said "who puts a baby gate 5 steps up??". He also looked at the actual baby gate, which was bent from PJ climbing on it (he weighs 36 pounds) but it is not destroyed or anything. He also commented that the EMT reported that the gate was intact, which obviously it could not have been had a 186 pound man fallen over it. To make a long story even longer, we were told that the investigation was over (it was closed as an accident). We were tired of looking at the mess so we hired a painter to fix the walls. He patched everything and skim coated all the walls because they had dings in them. I didn't have any idea this was going to happen so I didn't think it was going to be a problem. I did have several people come and look at the place on the wall where the baby gate was (and you can still see some marks on the wood frame around the door) so I have witnesses as to what it looked like. The painter is someone we hired off a realtor list and he is willing to testify as to what condition the walls were in. He was finishing up the day we were in court and had his truck in all the media hoopla. There is a lot of stuff in our favor but it is just so scary because of all of the Marcus Fiesel stuff. I am afraid we won't be treated fairly. Thanks for brainstorming for me. Let me know if you think of anything else.

My prayers are with you. So often our justice system can be unjust, it is plain scary.

God bless you for your dedication to special needs adults. My 3 year old is MRDD, so, one day, I will be providing for him as an adult, too. I can't imagine how it must feel to give your heart to such a selfless profession, only to be wrongly accused of endangement.

That is truly a nightmare. Why is it that when good people are doing great things for others, problems can arise!! It's so unfair. Just know (you have to really know) that God will take care of you each step of the way. Hang in there and take it one step at a time.
